These general terms and conditions of sale apply between:

Any order placed on the website www.k-eyes.com implies prior consultation and acceptance of these general terms and conditions.
The site www.k-eyes.com being a distance selling platform, the Customer acknowledges being fully informed that their agreement to the content of these general terms and conditions of sale does not require a handwritten signature on this document.
The Customer is invited to save and print these general terms and conditions of sale, which are binding between the parties.
The Customer declares to be of legal age and to have full legal capacity allowing them to commit under these general terms and conditions and thus enter into contracts under French law.
1 - PURPOSE
These general terms and conditions aim to define the rights and obligations of the parties within the framework of distance selling of goods offered on the website www.k-eyes.com, from order placement to after-sales services and warranties, including payment and delivery.
2 - AMENDMENT OF THE TERMS AND CONDITIONS OF SALE
The version of the general terms and conditions of sale binding on the Internet user is the one displayed on the site at the time the Customer validates the order or logs into this site.
Different versions of the general terms and conditions of sale are kept by K-EYES.
The general terms and conditions of sale may be modified or removed at any time by the site publisher or its agent.
3 - SITE UNAVAILABILITY
The website www.k-eyes.com or access to one or more services within the site, such as the online sales area, may be temporarily or permanently closed without notice or compensation, and no Internet user may claim any compensation.
4 - PRODUCTS
4.1 Availability
The products offered for sale by K-EYES, namely reading magnifying glasses, sunglasses with or without prescription, optical frames, and various accessories, are those listed on the website www.k-eyes.com at the time the Customer views the site.
Products are offered while stocks last. Although stock levels are displayed in real time on the website www.k-eyes.com, a product may be out of stock (inventory error or other). In such cases, K-EYES commits to informing the Customer as soon as possible after the order.
In this case, K-EYES may, in agreement with the Customer, schedule a new delivery date based on restocking. If no agreement is reached or if the ordered product is unavailable, K-EYES will refund the amounts paid by the Customer within a maximum of 10 days, without the Customer being entitled to any compensation.
4.2 Information and guarantees
The utmost care is taken when posting information online prior to placing an order, particularly regarding the essential characteristics of the products for sale, payment methods, and delivery terms. However, minor variations in the product representation that do not affect essential characteristics may occur. These variations shall in no way engage the contractual liability of K-EYES.
An online reading test is available to the Customer on each product page concerning the "reading glasses" category, during the step prior to placing the order. This test is not intended to replace an eye exam and does not engage K-EYES's responsibility for improper use by the Customer.
The information posted on the website www.k-eyes.com does not exempt the Customer from reviewing any other information attached to the product or displayed on the product or its packaging (description, usage precautions, cleaning conditions, etc.).
A damaged or modified product must not be used (significant scratches, etc.).
4.3 Use of Goods
The Customer agrees to use the products according to their intended purpose and to follow the product instructions for proper use.
K-EYES cannot be held responsible for misuse of the products, especially for uses other than those intended.
5 - PRICES
Prices related to product orders are indicated on the K-EYES website dedicated to this purpose.
Prices are displayed in euros and either excluding VAT (20%) or including VAT depending on the country of origin of the Internet users and their customer group, professional or individual. The mention of excluding or including VAT is shown in the order summary.
Unless otherwise stated, these prices do not include shipping fees, which will be indicated in addition to the price during the order process and before the Customer confirms their order.
Upon email confirmation of the Customer's order, delivery fees may be added to the product price. These are calculated as follows: the price is based on the country and the weight and/or amount of the order.
The Customer is responsible for paying any other taxes, customs duties, or import fees specific to the delivery country.
Product prices do not include communication fees related to the use of the online sales service, which remain the responsibility of the Customer.
K-EYES reserves the right to change its prices at any time. However, products will be billed based on the rates in effect at the time the order is recorded.
6 - ORDER
6.1 Order Placement
To place an order, the Customer can select one or more items and add them to their cart. The process of selecting reading glasses includes an additional step, the selection of the diopter, which is necessary to validate the order.
The order process includes the following steps:
- Step 1: fill the shopping cart.
- Step 2: the information provided by the Customer when opening their Customer account or with each order must be complete, accurate, and up to date. Otherwise, K-EYES will not be able to process the orders. If the Customer does not wish to provide such information, K-EYES will not be able to fulfill their order.
- Step 3: review the general terms and conditions of sale.
- Step 4: accept all the general terms and conditions of sale by checking the box "I accept the general terms and conditions of sale."
- Step 5: Confirm the order by clicking the "Confirm my order" button.
The Customer receives an order receipt summary by email.
Any order placed by the Customer through the above steps constitutes an irrevocable acceptance of the general terms and conditions.
6.2 Validity of the offer
Any order will be fulfilled subject to available stock.
The geographical coverage area for the offer and delivery is worldwide except for countries under trade embargo or subject to special customs regulations.
Any credit and/or discount code cannot be combined with promotional offers. Likewise, multiple discount codes cannot be combined on the same order.
All items in the Low Price category and those on promotion during Sales and Black Friday periods are refundable (excluding shipping costs) but not exchangeable. In case of product defect upon receipt, the Customer must contact Customer Service by clicking here so that a solution can be provided.
6.3 Order confirmation
In accordance with applicable regulations, the contractual information will be confirmed at the appropriate time and no later than at delivery, by email to the address provided by the Customer on the order form.
This confirmation email will include the following information in particular:
- the order number identification;
- the product description;
- the total order amount (price and shipping fees);
- a reminder of the payment security conditions.
It is the Customer's responsibility to keep the contractual information on the medium of their choice.
K-EYES reserves the right not to confirm the order, especially in case of payment authorization refusal, incorrect address, or any other problem with the user’s account. In this case, K-EYES will inform the Customer by email.
The order only becomes final after:
- full payment of the price by the Customer;
- verification of product availability by K-EYES as soon as possible from the sending of the email acknowledging receipt of the said order to the Customer.
For placing orders, business hours are Monday to Friday from 8 a.m. to 5 p.m. (French time).
The order can be canceled within 5 minutes following order confirmation and only during business hours by sending an email to Customer Service by clicking here. Any recorded order cannot be modified.
7 - PAYMENT
7.1 Payment methods
Payment is made online by credit card, PayPal, Stripe, or Alma. The invoice is available upon simple request by clicking here.
The order is only final once payment has been confirmed by the buyer. Any unpaid order will be automatically canceled.
For credit card payments made on its site, K-EYES uses Stripe's 3D Secure secure payment service. All information transmitted from the site www.k-eyes.com to the payment system is systematically encrypted to ensure confidentiality.
7.2 Non-payment
In the case of non-payment of the price without a legitimate reason, K-EYES is entitled to charge you late payment interest calculated based on the current legal rate plus three percentage points, applicable from the payment due date.
In the event of contentious recovery (collection agency, lawyer, or bailiff) and after a simple letter, K-EYES's claims against professionals will be increased by 40 euros as a fixed recovery fee, without prejudice to a claim for actual costs.
7.3 Retention of title
The delivered product remains the property of K-EYES until full and effective payment of the price by the Customer. Failure to pay may result in K-EYES reclaiming the product.
The transfer of risk of loss or damage to the Customer occurs on the delivery date of the product, that is to say upon receipt of the product by the Customer.
8 - DELIVERY TERMS AND TIMES
8.1 Delivery times
Products ordered by the Customer will be delivered within a maximum of 15 days from order confirmation and payment.
In case of product unavailability, K-EYES commits to inform the Customer as soon as possible so that the Customer can be refunded without delay and no later than 30 days from the payment of the amounts paid.
In case of a foreseeable extension of the delivery time, K-EYES commits to inform the Customer as soon as possible so that they can choose to maintain or cancel all or part of their order.
K-EYES cannot be held liable for the consequences of any events beyond its control, including force majeure or accidental events, which may delay or prevent the delivery of the ordered product.
In case of non-compliance with the mentioned deadline plus 7 days, the Customer may cancel their order by sending a registered letter with acknowledgment of receipt to the head office address indicated at the top of these general conditions. Cancellation will only be considered by K-EYES if shipment or delivery has not occurred between the sending and receipt of said letter. The Customer will be refunded no later than 14 days after K-EYES receives the registered letter.
K-EYES reserves the choice of carrier and guarantees the proper delivery of products.
8.2 Delivery inspection
The order delivery is made to the address provided by the Customer.
K-EYES guarantees the conformity of the delivered product to the essential characteristics described on the website www.k-eyes.com and for use in accordance with its intended purpose.
The Customer is required to check the condition of the packaging and the conformity of the delivered product, and if necessary, to make any reservations on the carrier's delivery note.
In case of:
- Apparent defect
The Customer agrees to verify the product's compliance with their order upon delivery. Any delivery error compared to the order or apparent defect must be claimed within 14 calendar days from delivery. After this period, the product will be considered received by the Customer, who can no longer claim a delivery error or apparent defect. After agreement by both parties, a refund will be made within 14 days or the product will be returned within 30 days.
Once the manufacturing defect is confirmed, the return of the product or its refund will be made within 14 days. This only applies in the case of a manufacturing defect, and not in cases of poor product maintenance.
- Damage and partial loss
In accordance with Article L 133-3 of the Commercial Code, receipt of the transported items extinguishes any action against the carrier for damage or partial loss if within three days, excluding public holidays, following that receipt, the recipient has not notified the carrier by registered letter of their motivated protest.
Claims related to the transport of products must therefore be noted on the transport document, then confirmed to the carrier and the publisher by registered letter with acknowledgment of receipt within three full days from the receipt of the products, under penalty of forfeiture of claims and complaints.
- Return to sender
If the Customer made an error in providing their postal address, refused the package, or did not collect it by the end of the initially announced deadline by the sender, and the package is therefore returned to the sender, the Customer must contact Customer Service by clicking here.
Two options will be offered:
1) The Customer wishes to receive the order again and provides K-EYES with an exact and complete address. Reshipping costs are the Customer's responsibility;
2) The Customer may also request a refund of their order; however, return shipping costs and other taxes will remain their responsibility.
For foreign customers outside Europe, K-EYES reserves the right to request reimbursement of shipping costs and customs taxes incurred if the package is returned to its premises, in addition to reimbursing the initial shipping fees.
8.3 Carrier
The choice of carrier is up to K-EYES. Packages are oversized and protected.
8.4 Customs Fees
Shipments outside the European Union may be subject to potential taxes and customs duties.
Customs duties are taxes imposed by a government on imported goods, which increase their cost upon entry. These taxes serve several purposes, including protecting domestic industries, generating public revenue, and balancing trade relations. When a customs duty is applied, the importer pays the additional duties at customs before the goods are cleared.
Although these fees are very rarely applied, they are applied randomly. They depend entirely on the customs policies of each country, and we have no way of knowing these fees in advance. These fees are the responsibility of the person receiving the shipment.
8.5 Importation into the United States
Changes to U.S. trade policy result in increased landing costs due to customs duties.
Starting August 29, 2025, the De Minimis rule will be removed for all shipments imported into the United States, regardless of the country of origin or shipment value. All shipments will have to go through the U.S. Customs and Border Protection (CBP) and may be subject to duties, taxes, and brokerage fees. Generally, these fees are the responsibility of the person receiving the shipment.
9 – WARRANTY
9.1 Guarantee against hidden defects
K-EYES is required to respect the legal guarantee against hidden defects, as defined in Article 1641 of the Civil Code, which states: "the seller is liable for the guarantee against hidden defects of the item that make it unfit for the use for which it is intended, or that so diminish this use that the buyer would not have acquired it, or would have paid a lower price, if they had known about them."
In all cases, K-EYES cannot be held responsible for misuse of the product by the Customer, normal wear and tear of the product, or lack of maintenance.
9.2 Non-compliance
In case of non-compliance of the delivered product, the Customer must inform K-EYES Customer Service by clicking here, clearly stating the observed non-compliance.
In accordance with Article 1648 of the Civil Code, the Customer has 2 years from the day they take possession of the product to enforce the conformity guarantee.
9.3.1 If the defect appears within 6 months of purchase
If the product defect appears within 6 months of purchase, it is presumed to have existed at the time of acquisition.
9.3.2 If the defect appears more than 6 months after purchase
If the defect appears more than 6 months after purchase, the Customer can only benefit from the conformity guarantee if they provide proof that the defect existed at the time of purchase.
To this end, the Customer may present any document likely to prove the product's non-compliance.
9.3.3 Taking the Customer's Request into Account
K-EYES commits, based on the Customer's request, to exchange or refund the product to the Customer, provided it is returned in its original packaging. In case of a clear cost difference between the two options, K-EYES will choose the less expensive solution. For returns due to defects, K-EYES refunds shipping costs upon presentation of the corresponding receipts and in any case according to current rates. The refund is proportional to the price of the product relative to the total order.
Subject to the Customer's consent, K-EYES may offer a credit note instead of an exchange or refund.
The provisions of this article do not prevent you from benefiting from the right of withdrawal provided for in article 11.
11 - RIGHT OF WITHDRAWAL
In accordance with article L 121-20-1 and following of the Consumer Code, the Customer has a withdrawal period of fourteen days from the date of receipt of the order.
If the Customer exercises this right of withdrawal, the product must be returned in its original packaging, in a condition consistent with that initially received, the item must not have been worn or damaged, without excessive handling (scratches on lenses, no significant deterioration of packaging), no later than 14 days from the date of receipt of the order and accompanied by all accessories and any instructions and the invoice reference related to the products.
A product that has depreciated due to excessive handling (notably damaged, incomplete return, worn, without tags, etc.) cannot be accepted for return or refunded.
Customers will bear the cost of their return and will also be responsible for any customs duties.
Any promotional item such as Flash Sales, Sales, Black Friday, or from the Low Prices section is neither accepted for return nor refunded.
In case of exercising the right of withdrawal, in accordance with the withdrawal form attached in appendix 1, the Customer may request a refund of their order.
K-EYES commits to refund the Customer within a maximum of 14 days from the actual return of the product. K-EYES reserves the choice of refund method, by bank transfer (the Customer must then provide their IBAN), by check, or by PayPal.
Any product return must be requested through our Customer Service via the contact form or by phone as specified at the beginning of these terms.
12 - PERSONAL DATA PROTECTION
The information requested, notably via forms, is necessary for processing the order and will be communicated to the service provider(s) responsible for fulfilling the order, including the carrier and/or any competent authority for resolving a dispute between K-EYES and a Client. It may also be used to better understand the Client and tailor the K-EYES offer to the Client’s needs.
In accordance with law n°78-17 of January 6, 1978, relating to data processing, files, and freedoms, the processing of personal information collected on the website has been declared under receipt n°1888262 v 0 to the National Commission on Informatics and Liberty (CNIL). The Client has the right to access, modify, correct, and delete data concerning them. To exercise this right, the Client must send an email to the K-EYES Customer Service at the email or postal address indicated at the top of these general conditions.
13 - INTELLECTUAL PROPERTY
Elements belonging to K-EYES, such as the website, trademarks, games, designs, models, images, sound clips and videos, texts, photos, logo, graphic charter, without this list being exhaustive, are the exclusive property of K-EYES.
These general conditions do not transfer any intellectual property rights of any kind on elements belonging to K-EYES to the benefit of the Client.
K-EYES grants you a non-exclusive, personal, non-transferable right to access the site for use that complies with the conditions set forth herein. Any other use constitutes counterfeiting and is subject to criminal penalties under Intellectual Property law.
The Client is prohibited from infringing, directly or indirectly, on the property rights of K-EYES and is forbidden from exploiting in any way the names, trademarks, or logos. The Client agrees to respect all rights of K-EYES and is prohibited from creating any association in the public’s mind for any purpose.
Hypertext links to the homepage of the site www.k-eyes.com or any other page must always be subject to a request for authorization and must be removed upon simple request from K-EYES.
La Maison K-EYES® has no direct or indirect ownership links with the company KLEYES.
14 - MENTIONS RELATING TO THE COLLECTION OF "COOKIES"
To enable the user to navigate optimally on the K-EYES site and to improve the functioning of various interfaces and applications, the publisher may place a cookie on the user's computer. This cookie stores information related to navigation on the site (date, page, times), as well as any data entered by users during their visit (searches, login, email, password).
These cookies are intended to be stored on the user's computer for a variable duration and may be read and used by the publisher during a subsequent visit by the user to this site. The user has the option to block, modify the retention period, or delete this cookie via their browser interface (usually: tools or options / privacy or confidentiality). In such a case, browsing this site will not be optimized. If the systematic disabling of cookies on the user's browser prevents them from using certain services or features provided by the publisher, this malfunction shall in no way constitute damage to the user, who cannot claim any compensation as a result.
15 - LIABILITY
K-EYES cannot be held responsible for failure to perform its obligations due to a fortuitous event and/or force majeure as generally accepted by law and French courts or for causes beyond its control.
In any case, K-EYES's liability is limited to the price of the product sold unless otherwise required by mandatory law.
Furthermore, K-EYES cannot be held liable to the extent permitted by applicable law for direct, including non-material, or indirect damages that may result from access to the site or inappropriate use of the products as defined in the "product use" article, especially when these products contain usage restrictions.
It is also recalled that the hyperlinks placed on www.k-eyes.com may link to other sites whose content remains the sole responsibility of the operators and owners of those sites.
16 – FORCE MAJEURE / FORTUITOUS EVENTS
Explicitly, those usually recognized by the case law of French courts and tribunals are considered cases of force majeure or fortuitous events.
The performance by K-EYES of all or part of its obligations will be suspended in the event of a fortuitous event or force majeure that would hinder or delay its execution.
K-EYES will inform the Customer of such a fortuitous event or force majeure within 14 days of its occurrence. If this suspension continues beyond 15 days, the Customer will then have the option to cancel the current order, and a refund will be made under the conditions stated above.
17 - ENTIRE AGREEMENT
In the event that any clause of this contract is null and void due to a change in legislation, regulation, or a court decision, this shall in no way affect the validity and compliance of the rest of these general terms and conditions of sale.
18 - DURATION
These terms apply for the entire duration of the online availability of the services offered by K-EYES.
19 - EVIDENCE
The computerized records, kept on K-EYES servers or those of its hosts, will be considered, barring proof to the contrary, as evidence of communications, orders, and payments made between the parties.
20 - APPLICABLE LAW
These terms are subject to French law. This applies to both substantive and procedural rules.
Under no circumstances does K-EYES guarantee compliance with local legislation that would apply when an Internet user accesses the site from another country.
In case of dispute, failing an amicable agreement, the dispute will be under the exclusive jurisdiction of the French court competent for a dispute between K-EYES and a non-professional, and the Commercial Court of Fréjus for a dispute with a professional.
ANNEX 1 WITHDRAWAL FORM
In accordance with article L 121-20-1 and following the Consumer Code, the non-professional Customer has a withdrawal period of fourteen days from the date of receipt of the order.
I, the undersigned, Mr./Mrs./[to be filled in], inform you of my right of withdrawal regarding order no. [to be filled in] placed on your website.
I hereby request that you proceed with the refund of the amounts paid for this order, excluding shipping and return costs incurred, within a maximum period of 14 days after the effective return of the said ordered product.
I also commit to returning the ordered product at my own expense within 14 days from the date of exercising my right of withdrawal, in compliance with the provisions of article 11 of the Terms and Conditions of Sale, namely a product that has not been depreciated.
